Custom-made package tour travel terms and conditions
(Explanation of Travel Conditions under Article 12-4 of the Travel Agency Act) (Contract Document under Article 12-5 of the Travel Agency Act) *When Iris Co., Ltd. (hereinafter referred to as "our company") undertakes travel arrangements at the customer's request, the following applies in addition to what is stated in the travel itinerary (course plan) and travel conditions (or quotation). This travel transaction conditions document becomes part of the contract document if a travel contract is concluded. 1. Customized Package Tour Contract A "customized package tour contract" (hereinafter referred to as "the contract") refers to a travel contract in which our company, at the customer's request, creates a travel plan specifying the purpose and itinerary of the trip, the content of transportation and other services that the customer can receive, and the amount of travel price that the customer should pay to our company, and then implements the trip accordingly.
2. Application for Contract (1) When a customer requests to apply for a travel contract, unless there are operational reasons for not doing so, we will provide a document (hereinafter referred to as the "Planning Document") containing the travel itinerary, travel services, travel price, and other travel conditions, prepared in accordance with the content of the request. (2) In the Planning Document mentioned in the preceding paragraph, we may specify the amount of the handling fee related to the planning (hereinafter referred to as the "Planning Fee") as a breakdown of the travel price. (3) Customers who wish to apply for a travel contract based on the contents of the Planning Document provided by us must fill in the required information on our prescribed application form and submit it to us along with an application fee equivalent to 20% of the travel price. (4) Notwithstanding the provisions of the preceding paragraph, customers wishing to apply for a communication contract with our company (a travel contract concluded with a cardholder of a credit card company with which our company has a partnership, based on an application received via telephone, mail, fax, or other means of communication, where the customer agrees in advance to settle the debts or obligations related to the travel price, etc., under the travel contract with our company in accordance with the card terms and conditions of the partner company, which will be separately determined after the date on which such debts or obligations are due, and agrees to pay the travel price, etc., under the said travel contract) must notify our company of their membership number (credit card number, expiration date) and other relevant information. (5) When multiple customers wishing to participate in the same tour apply for a travel contract, designating a responsible representative (hereinafter referred to as the "Contract Representative"), our company will consider the Contract Representative to have full authority to act on behalf of the customers regarding the conclusion and cancellation of the travel contract. (6) The Contract Representative must submit a list of participants to our company by the date specified by our company. (7) We assume no responsibility for any debts or obligations that the contracting party currently owes or is expected to owe to the group members in the future. (8) If the contracting party does not accompany the group, after the start of the trip, we will consider the member designated in advance by the contracting party as the contracting party. (9) Multiple reservations that cannot actually be used due to the itinerary (hereinafter referred to as "duplicate reservations") are not permitted. In this case, one of the "duplicate reservations" will be automatically canceled according to the criteria set by the airline or accommodation provider in accordance with their reservation management policy. (10) If you currently have health problems, chronic illnesses, are pregnant, have a disability, have other health reasons, or use a service animal, and require special consideration or special consideration when walking during the trip, please be sure to inform us at the time of booking. We may request the submission of a prescribed "Inquiry Form" or "Health Certificate." We will comply to the extent possible and reasonable. Please note that any costs incurred for special measures taken by our company at the customer's request will be borne by the customer. Furthermore, depending on local conditions, transportation and accommodation circumstances, etc., in order to ensure the safe and smooth execution of the trip, we may require the accompaniment of a caregiver or companion, or we may recommend a less burdensome alternative trip or decline your participation. In addition, we may modify parts of the travel contract.
3. Refusal to Conclude a Contract Our company may refuse to conclude a contract in the following cases: (1) When there are business reasons on our part. (2) When attempting to conclude a communication contract, and the customer's credit card is invalid, or for other reasons, we are unable to settle part or all of the debt related to the travel price in accordance with the affiliated company's cardholder agreement. (3) When there is a risk of causing inconvenience to the customers' travelers or hindering the smooth execution of group activities. (4) We reserve the right to refuse participation if we determine that a customer is a member of an organized crime group, a quasi-member of an organized crime group, a person associated with an organized crime group, a company associated with an organized crime group, a corporate racketeer, or any other anti-social force. (5) We reserve the right to refuse participation if a customer engages in violent demands, unreasonable demands, threatening behavior or violence in relation to transactions, or similar acts against us. (6) We reserve the right to refuse participation if a customer spreads rumors, uses deception or intimidation to damage our reputation or obstruct our business, or engages in similar acts.
4. Time of Contract Formation (1) The contract is formed when we accept the conclusion of the contract and receive the application fee. (2) We may accept applications for contracts without receiving an application fee by special agreement in writing. In this case, the contract is formed when the special agreement document is delivered. (3) The application fee will be applied to a portion of the travel price, cancellation fee, and other amounts payable by the customer to our company. (4) Notwithstanding the terms and conditions in (1), the communication contract is concluded when our company receives notification of acceptance from the customer and the notification of acceptance of the application reaches the customer.
5. Delivery of Contract Document (1) After the contract is concluded, our company will promptly deliver a contract document to the customer containing the travel itinerary, the content of the travel services, the travel price, other travel conditions, and matters concerning our company's responsibilities. (2) When a contract document is delivered, the scope of travel services for which our company is obligated to arrange and manage the itinerary under the package tour contract shall be as described in the contract document mentioned in the preceding paragraph.
6. Issuance of Confirmation Document (1) If the confirmed travel itinerary or the names of transportation or accommodation providers cannot be stated in the contract document, the names of the planned accommodation providers and important transportation providers will be stated in the contract document. A confirmation document detailing these confirmed details will be issued by the date specified in the contract document, no later than the day before the travel start date (or the travel start date if the contract application was made on or after the 7th day prior to the travel start date). (2) In the preceding paragraph, if a customer wishes to confirm the arrangement status, we will respond promptly and appropriately, even before the issuance of the confirmation document. (3) When a confirmation document is issued, the scope of travel services for which we are obligated to arrange and manage the itinerary will be specified in the confirmation document.
7. Payment Timing and Changes to Travel Price (1) The amount of the travel price will be stated in the planning document for the customized package tour. Please pay the tour price by the deadline set by our company before the departure date. (2) If the applicable fares and charges (hereinafter referred to as "applicable fares and charges") for the transportation services used are revised significantly beyond what is normally expected due to significant changes in economic conditions, etc., compared to the applicable fares and charges publicly announced as valid on the reference date stated in the tour plan, we may increase or decrease the tour price by the difference. (3) If we increase the tour price, we will notify you at least 15 days prior to the departure date. In this case, you may cancel the contract before the start date of the trip without paying any planning fees or cancellation fees. If the applicable fares and charges are reduced, we will reduce the tour price by the difference. (4) If we state in the contract that the tour price will differ depending on the number of users of transportation and accommodation services, and the number of users changes after the contract is concluded due to reasons not attributable to our company, we may change the amount of the tour price as stated in the contract.
8. Changes to Contract Details (1) When a customer requests changes to the contract details, we will comply with the customer's request to the greatest extent possible. In this case, we may change the tour price. (2) In the event of natural disasters, wars, riots, suspension of travel services by transportation or accommodation providers, government orders, provision of transportation services not in accordance with the original operating plan, or other circumstances beyond our control, if it is unavoidable to ensure the safe and smooth execution of the trip, we may change the travel itinerary, the content of travel services, and other details of the customized package tour, after promptly explaining to the customer in advance the reasons why such circumstances are beyond our control and the causal relationship with such circumstances. However, in urgent cases where it is unavoidable, we will provide an explanation after the change.
9. Change of Customer (1) When a customer requests changes to the contract details, we will comply with the customer's request to the greatest extent possible. In this case, we may change the tour price. (2) In the event of natural disasters, wars, riots, suspension of travel services by transportation or accommodation providers, government orders, provision of transportation services not in accordance with the original schedule, or other circumstances beyond our control, if it is unavoidable to ensure the safe and smooth execution of the trip, we may change the travel itinerary, the content of travel services, and other details of the customized package tour. We will promptly explain to the customer in advance the reasons why such circumstances are beyond our control and the causal relationship between such circumstances and the changes. However, in urgent cases where it is unavoidable, we will provide an explanation after the changes have been made.
10. Cancellation of Travel Contract (1) Cases where the customer is charged a planning fee or cancellation fee a. The customer may cancel the travel contract by paying the planning fee or cancellation fee stated in the planning document. b. Even in the case of cancellation due to reasons not attributable to our company, such as loans or travel arrangements, the cancellation fee stated in the planning document will be charged. (2) Cases in which no planning fee or cancellation fee is charged to the customer The customer may cancel the contract before the start of the trip without paying a planning fee or cancellation fee in the following cases: a. When a significant change is made to the travel contract as exemplified in the left column of the table in paragraph 14. b. When the travel price is increased (except when the customer requests a change to the contract details). c. When natural disasters, wars, riots, suspension of travel services by transportation or accommodation providers, government orders, or other circumstances occur, making it impossible or highly likely to become impossible to safely and smoothly carry out the trip. d. When we fail to deliver the confirmation document to the customer by the due date. e. When it becomes impossible to carry out the trip according to the travel itinerary described in the contract document due to reasons attributable to us. (3) If, after the start of the trip, the customer is unable to receive the travel services described in the contract document due to reasons not attributable to the customer, or if we notify the customer of this fact, notwithstanding the provisions of (1), the customer may terminate the contract for the portion of the travel services that could not be received without paying the planning fee or cancellation fee. In this case, we will refund the customer the amount of the travel price corresponding to the portion that could not be received. (4) We will deduct from the amount of the travel services that could not be received the travel services,
